What Is The Fair Debt Collections Act?
The Fair Debt Collections Act (the Fair Debt Collection Practices Act or FDCPA) is a federal law regulating debt collectors. The act ensures debt collectors eliminate certain practices in their effort to collect consumer debt on behalf of their clients. These debts could include personal, family and household debts, such as money owed on credit card, vehicle loan, a medical bill or home mortgage. The Fair Debt Collections Act does not cover debt collections related to business debt.
Asking Debt Collectors to stop calling a certain number.
Sometimes it may be necessary to stop a debt collector from calling a certain number, for example some consumer's employers may not allow them to receive personal phone calls during working hours. A consumer can request that the debt collector call another number instead of a work number.
What rules must debt collectors abide by in the Fair Debt Collections Act?
Debt collectors cannot discuss a consumer's financial matters with a third party, such as friends and neighbors. A debt collector may, however, discuss a consumer's financial matters with a consumer's legal representative, such as a lawyer.
Debt collectors cannot use obscene or profane language when attempting to resolve a debt with a consumer.
Debt collectors cannot report false information on a consumer's credit report.
